Abstract
Introduction & Background: The position of the sheriff is currently vacant due to the retirement of Sheriff Mike Roberson. North Carolina General Statute § 162-5 states that if any vacancy occurs in the office of the sheriff, the chief deputy shall execute all process directed to the sheriff until the first meeting of the board of county commissioners next succeeding such vacancy.
Discussion & Analysis: North Carolina General Statue § 162-5 further states that the board of county commissioners shall not make any appointment until first being presented with a valid disclosure statement by the North Carolina Sheriff’s Education and Training Standards Commission pursuant to Article 3 of Chapter 17E of the General Statutes with respect to the individual being appointed.
