Vote to adopt a resolution reverting Parcel 0091272 to the Briar Chapel Community Association, Inc and approving the Quitclaim Deed
Abstract
Introduction & Background: A Conditional Use Permit for Briar Chapel was originally approved by Chatham County on or about February 15, 2005.
The Conditional Use Permit was amended in November 2014 to require a conveyance by NNP-Briar Chapel, LLC (the Developer), to the County of an approximately 3.7-acre tract of land known as the "Civic Site."
The Special Warranty Deed was recorded at Book 1833, Pages 249, Chatham County Registry. The Civic Site was limited to use for civic uses, structures, and facilities.
In accordance with Section 14(d) of the Conditional Use Permit, the Special Warranty Deed, by its terms, included a reversionary interest in favor of the Developer in the event certain events did not take place before December 31, 2025.
Those events were (1) the issuance of a building permit on the site with construction to commence in 6 months and finish in 18 months or, (2) if the site was used for purposes that did not involve structures, that the property was made open to the public for that use.
On July 1, 2025, NNP-Briar Chapel, LLC, assigned its potential reversionary interest to the Briar Chapel Community Association, Inc. That transfer was recorded at Book 2475, Page 897, Chatham County Registry.
The County Departments reviewed potential uses for the Civic Site, but the County ultimately concluded that the County did not have a civic use for the Civic Site.
Accordingly, the Civic Site reverted to the Briar Chapel Community Association, Inc. The Briar Chapel Community Association, Inc., is asking the County to execute the quitclaim deed to eliminate any uncertainty concerning ownership of the Civic Site in title records. The Briar Chapel Community Association, Inc. is going to use the property for common area, and the quitclaim deed states that.
