Abstract
Action Requested: Vote on a request to repeal Chapter 94 of the Chatham County Code of Ordinances
Introduction & Background: Pursuant to G.S. 130A-39, the Chatham County Board of Health has the authority to adopt appropriate rules for the protection of the public health. On November 23, 2010, the Chatham County Board of Health adopted Child Lead Poisoning Prevention Rules. For reasons that are unclear, when Chatham County subsequently decided to codify County ordinances, the Code of Ordinances adopted by the Chatham County Board of Commissioners included the Rules as Chapter 94.
Discussion & Analysis: This inadvertent codification of the Rules was recently discovered. The Board of Commissioners desires to clarify that the Rules are and should be Rules of the Board of Health and not County ordinances. This ordinance is not intended to in any way affect the Board of Health’s Rules, or the authority of the Board of Health to adopt or amend such rules.
