Vote to authorize the County Manager to execute and submit all necessary participation forms and future documents related to Sandoz Inc., Purdue Pharma, and other opioid settlements, as needed, to preserve the County's eligibility for any associated funds, and to dismiss the Henry Schein Company settlement and any other opioid settlements upon the recommendation of Chatham County's legal counsel.
Abstract
Introduction & Background:There continues to be activity related to national opioid litigation, and Chatham County remains eligible to participate in ongoing settlement agreements as a litigating subdivision.
Discussion & Analysis: The County has recently been notified of two additional proposed settlements:
1. Sandoz Inc.
2. Purdue Pharma, its affiliates, and the Sackler family
To receive any potential settlement funds, the County must complete and submit the required Participation Forms for both agreements. Subdivisions that do not submit the forms will not be eligible to receive funds from these settlements.
In addition to these two new settlements, there is one existing settlement the County has joined that the County's National and local legal counsel have recommended the County dismiss. Specifically, it has been determined that Henry Schein Company, one of the Defendants in our Opioid Litigation, only had a 0.003% market share in Chatham County. The Henry Schein Company is refusing to pay, and the cost of pursuing would not justify the anticipated return.
