Vote to amend the Chatham County Criminal History Check policy
Abstract
Introduction & Background: The Chatham County Criminal History Check policy was first adopted on June 6, 2011 and established a procedure for conducting criminal history checks through the Division of Criminal Information Network (DCI). Currently, all those in the county’s service, including full and part-time employees, temporary employees, and volunteers are subjected to a criminal history check. The policy also provides the opportunity for volunteer fire departments and rescue squads to conduct criminal history checks through county emergency communications.
Discussion & Analysis: The passage of Session Law 2015-16 (House Bill 612) enacted various changes to the laws affecting juveniles and associated services and now requires all counties and cities in North Carolina to subject all applicants for positions that require working with children in any way to criminal history record checks conducted by the North Carolina State Bureau of Investigation (SBI).
These checks must be conducted in accordance with G.S. 143B-1209.26, the statute which authorizes the SBI to provide a fingerprint-based state and national criminal record check to cities and counties.
The proposed amendment to the Chatham County Criminal History Cheick policy reflects the new requirement as dictated by G.S. 143B-1209.26.
