Abstract
Introduction & Background: N.C. Gen. Stat. § 143-64.31, commonly referred to as the “Mini-Brooks Act,” establishes the policy of the State requiring qualifications-based selection for architectural, engineering, surveying, construction management at risk, design-build, and other professional services subject to the Act. N.C. Gen. Stat. § 143-64.32 authorizes units of local government to exempt projects from the requirements of the Mini-Brooks Act when the estimated professional fee for such services is less than fifty thousand dollars ($50,000).
Discussion & Analysis: Chatham County is undertaking the Emergency Operations Center Phase II Project and requires professional services that may include architectural and interior design services, civil and stormwater engineering services, surveying, traffic and safety analysis, permitting and coordination, preparation of bid documents, and other related professional services, which may be provided through separate professional services contracts. Emergency Operations Center Phase II Project may require multiple professional disciplines and separate professional service contracts, and the estimated professional fee for each such professional services contract is less than fifty thousand dollars ($50,000).
