Abstract
Action Requested: Motion to award the Atlantic Power Solutions, Inc. Bid to Replace the Pittsboro Fire Tower Radio Site Generator.
Introduction & Background: Chatham County maintains an emergency generator at its public safety radio tower site at 1056 Pittsboro Fire Tower Road. The generator and transfer switch failed on June 25, 2018 and are not repairable. Chatham County solicited bids between July 17, 2018 and July 27, 2018 for replacement of the generator and transfer switch. The only bid received was from Atlantic Power Solutions, Inc.
Discussion & Analysis: Commissioner Petty has more than ten percent (10%) ownership interest in Atlantic Power Solutions, Inc. N.C. Gen. Stat. § 14-234(d1) provides an exception to the conflict of interest prohibitions of N.C. Gen. Stat. § 14-234(a) for public officers in counties with no town or city located therein with a population of more than 15,000 based on the most recent official federal census. Atlantic Power Solutions, Inc. is currently maintaining the County’s generators under a contract approved and ratified by the Chatham County Board of Commissioners on or about the 21st day of August, 2017 pursuant to N.C. Gen. Stat. § 14-234(d1). Replacement of the generator and transfer switch equipment are not covered by the current service contract.
