Title
Receive a presentation and adopt a resolution approving the Chatham County Abandoned Cemetery Disinterment and Reinterment Policy
Abstract
Introduction & Background: North Carolina General Statute § 65-106 provides a process for the disinterment, removal, and reinterment of human remains from abandoned graves and cemeteries. Chatham County currently does not have a formal policy establishing local procedures and administrative responsibilities for reviewing and processing these requests. The proposed Chatham County Abandoned Cemetery Disinterment and Reinterment Policy establishes a clear framework to ensure requests are handled lawfully, respectfully, and consistently while protecting public health, preserving the rights of next of kin, and considering historical and cultural resources. The policy also clarifies the respective roles of the Board of Commissioners, Clerk to the Board, Public Health Director, applicants, and other involved parties.
Discussion & Analysis: The proposed policy establishes application requirements and review procedures for parties seeking to disinter and reinter remains from abandoned cemeteries within unincorporated areas of Chatham County. It outlines requirements for notice to next of kin, public notification, coordination with state/local archaeological authorities when appropriate, Board of Commissioners review and approval procedures, and compliance with all applicable state and federal laws.
How does this relate to the Comprehensive Plan: The proposed policy supports the Comprehensive Plan by promoting responsible stewardship of community resources, protecting cultural and historical assets, preserving public health and safety, and ensuring transparent and accountable local government processes. The policy provides a consistent framework for addressing abandoned cemetery matters while balancing property interests, community values, and the respectful treatment of human remains.
Budgetary Impact: Implementation of the policy is not expected to have a significant budgetary impact. Administrative responsibilities will be carried out by existing County staff as part of their regular duties. All expenses associated with approved disinterment, removal, and reinterment activities, including burial site acquisition, transportation, funeral services, marker replacement, and applicable recording fees, are the responsibility of the applicant as required by state law.
Recommendation/Motion: Adopt a Resolution approving the Chatham County Abandoned Cemetery Disinterment and Reinterment Policy.
