A legislative public hearing rezoning requested by Fearrington Property Development, LLC to rezone Parcels 2867, 2868, 2869, 2842, 2807, 2820, 95254, located off 724 Andrews Store Rd, Parker Herndon Rd, and Morris Rd., from R-1 Residential to CD-CC Conditional District Compact Community, being approximately 371.822 acres, Baldwin Township
Abstract
Introduction & Background:
A legislative public hearing was held April 20, 2026. Planning staff presented the request and noted several discrepancies in compliance with the Compact Community Ordinance. Members from other county departments also attended and spoke regarding their specific section of noncompliance or no agreements being reached for use of different aspects of the development (i.e. affordable housing, donated park land, etc.). This included Affordable Housing, Parks & Recreation, Watershed Protection, and the Fire Marshal’s Office. The applicant’s attorney, Nicholas Robsinson, also presented and stated several of these issues could be finalized as the process continues. Staff stated these matters should be decided on now rather than through the remaining process for public transparency and compliance with the Ordinance.
Several members of the pubic also spoke in opposition to the rezoning request. There was also a petition signed by several members of the community provided to the clerk to the board.
The Board of Commissioners voted to continue the public hearing until next month.
A second legislative public hearing was held May 18, 2026. Planning staff presented and noted continued concerns and discrepancies in compliance with the Compact Community Ordinance. Staff noted that there appear to be 3-4 variations of the master plan now in circulation, there is still an issue with the mitigation plan for Pokeberry Creek, concerns over traffic, affordable housing agreement has not been decided, donation of land for parks, spray areas for conservation, and others.
The Board of Commissioners expressed continued concerns and directed staff to compile a list of questions/concerns for the developer and to have answers at the next public hearing meeting. The public hearing was continued to the July 27, 2026, meeting.
