Action Requested: Vote on a request to convey a 0.47-acre parcel of land in ownership of Chatham County and located at 300 Elder Road, Siler City, NC to the Town of Siler City and execute the proposed Special Warranty Deed subject to this request.
Introduction & Background: The Town of Siler City is in the process of applying for a grant to upgrade the pumpstation at 300 Elder Road. The pumpstation and other improvements on the property belong to Siler City, while the land is owned by Chatham County. The grant that the Town is seeking funding from requires the property to be in the ownership of the Town. The Town, having found that the land is owned by Chatham County, is requesting the County convey the property to the Town to meet this eligibility requirement.
Discussion & Analysis: As noted, the property located at 300 Elder Road is approximately one-half of an acre, which is located at the end of a rural neighborhood street off Airport Road within the Town of Siler City ETJ. The county would have no known useful public purpose for this property, aside from its current use. NC G.S. 160A-274 authorizes any governmental unity to sell to any other governmental unit any interest in real or personal property upon such terms and conditions as it deems wise, with or without consideration. The proposed Special Warranty Deed specifies that the conveyance of this property is made in consideration of the sum of $10.00 and “other valuable considerations”.
