Vote to adopt a Resolution and approve an Ordinance for a revision to an approved CD-CC (Conditional District - Compact Community), Vicker’s Village, to modify the phasing schedule for Condition Numbers, 5, 6, 7, 8 and 22 of the last modified phasing schedule approved in November 2024, located off US 15-501 N and Jack Bennett Road, Williams Township

 

Abstract

Introduction & Background: A public hearing was held on August 18, 2025. Planning staff presented the request and Nick Robinson, attorney, made a presentation. Warren Mitchell was also in attendance to answer any questions.

 

In November of 2024, the Board of Commissioners approved a one-year extension of the First Plat approval. Approval of the construction plan occurred in February 2025 during a TRC (Technical Review Committee) meeting.

 

The applicant has provided a cover letter explaining why they are requesting another extension. The anticipated construction start date is set for December 2025.

                     

Discussion & Analysis: There are no changes to the submitted findings that were approved with the original submittal. All information shall remain in effect as reviewed and approved.

 

This request would extend deadlines as follows:

                     Phase 1: Lots 94-167 (74+/-). Final plat on or before December 31, 2028

                     Phase 2: Lots 1-93 and 168-189 (115 +/-). Final plat on or before December 31, 2029

                     Phase 3: Commercial Lot. Final plat on or before December 31, 2030

                     Building Permit: A building permit shall be issued, and remain valid at all times by December 31, 2029

 

This will be the same development schedule for the Subdivision request.

 

This item was on the consent agenda for the Planning Board during their regular meeting on September 2, 2025 and was recommended for approval by a vote of 10-0.

 

How does this relate to the Comprehensive Plan: The original approval was on November 15, 2021, for the Conditional District Compact Community. The first revision for a modification to the development schedule was November 18, 2024. This continues to be a viable project and will continue to support the Land Use Plan for the area by continuing to be located within an area identified as mixed used and compact community providing a mix of housing and a commercial component as stated in Chapter 2 of Plan Chatham.

Recommendation/Motion: The Planning Board by unanimous vote recommends adoption of an ordinance approving a revision to an approved CD-CC (Conditional District - Compact Community), Vicker’s Village, to modify the phasing schedule for Condition Numbers, 5, 6, 7, 8 and 22 of the last modified phasing schedule approved in November 2024 and as described in the application.

 

The Planning Board by unanimous vote recommends adoption of a resolution approving the following consistency statement:

 

                     Under Strategy 4.4, approval of this extension request will continue to permit existing and planned commercial uses that are appropriately zoned to continue to operate.
