TITLE
A legislative public hearing to consider a request to abandon a portion of the Moncure Flatwoods Road right-of-way and vote to adopt an Ordinance Permanently Closing a Portion of Moncure Flatwoods Road.

ABSTRACT

Action Requested:
A legislative public hearing to consider a request to abandon a portion of the Moncure Flatwoods Road right-of-way and vote to adopt an Ordinance Permanently Closing a Portion of Moncure Flatwoods Road.

Introduction & Background:
Pursuant to NCGS 153A-241, in order for portion of road Right-Of-Way to permanently close, there must be no maintenance by NCDOT in the Right-Of-Way, and a petition needs to be submitted requesting that the street be closed (typically by adjacent property owners), and then a Resolution of Intent to Permanently Close Street must be requested, which sets the public hearing date, and is drafted and placed on Board of Commissioners next agenda under consent items. A hearing has been requested to adopt a Resolution of Intent to permanently close a portion of Moncure Flatwoods Rd Right-of-Way as a result of adjacent property owner petition. NCDOT has abandoned maintenance on a portion of the Right-Of-Way of Secondary Road, Moncure Flatwoods Rd, in Cape Fear Township, Chatham County, North Carolina. In order for this road to have a portion of Right-Of-Way permanently closed, NCGS states that the Chatham County Board of Commissioners must adopt the resolution of Intent to set a public hearing as a result of petition. The applicant has prepared the resolution of intent in their materials in the attachment. The applicant also submitted confirmation about utility easements and recombination in those materials.

The applicant additionally submitted in their materials that the utility easements and recombination deeds and plats will be executed and properly recorded with the Chatham County Register of Deeds office upon the abandonment, closure, and conveyance of the Right-Of-Way by the County...
